Terms of Use of the Allianz Suisse Online Services for private individuals and insured persons at pension funds

Allianz Suisse offers

  • both its policyholders (hereinafter referred to as “Users”)
  • and people who are enrolled with

the Collective Foundation BVG of Allianz Suisse Life Insurance Company, the Collective Foundation for Supplementary Insurance of Allianz Suisse Life Insurance Company or Allianz Pension Invest (hereinafter referred to as “the Pension Funds”) for the provision of occupational pension cover (hereinafter referred to as “Users”) various online services (hereinafter referred to as “Online Services”) via the Allianz Suisse customer portal (here-inafter referred to as “the Customer Portal”) and/or the Allianz app (hereinafter referred to as “the App”).

“Allianz Suisse” comprises the following companies:

  • Allianz Suisse Insurance Company Ltd
  • Allianz Suisse Life Insurance Company Ltd
  • CAP Legal Protection Insurance Company Ltd

The User may use the Customer Portal and/or the App only in accordance with these Terms of Use. All other use is prohibited. The User is liable for all damage caused by un-authorised use of the Customer Portal and/or the App.

There is no entitlement to access the Customer Portal and/or the App.

The Customer Portal and/or the App allow the User to:

  • retrieve information (e.g. certain data of policyholders and jointly insured persons stored at Allianz Suisse)
  • access the services offered (e.g. electronic processing of certain transactions, such as changes of name, address, contact or account details)
  • exchange data with Allianz Suisse
  • access certain documents such as the pension fund certificate

Allianz Suisse may expand or restrict the scope of these Online Services at any time (see 4. Start and end of use).

By using this website, the User agrees that – where available – both insurance contracts of Allianz Suisse and other companies in the Allianz Group and pension information from the pension funds may be displayed in the Customer Portal and/or in the App. They are aware that this data may be of a highly personal nature.

Allianz Suisse will provide access to the Customer Portal and/or the App free of charge. The costs for Internet use depend on the tariff of the User’s Internet service provider.

Use of the Customer Portal and/or the App begins with the entry of the login code (see 6. Login) and can be terminated at any time. As soon as the User requests it, their access credentials will be deleted and their account will immediately be deactivated.

Allianz Suisse is entitled to restrict or completely discontinue the use of the Customer Portal and/or the App or to block access to them at any time. The User will be informed as soon as possible.

Allianz Suisse provides various registration procedures for using the Customer Portal and/or the App. As part of the registration process, Users must identify themselves with the required details.

If the identification process cannot be successfully completed in the first step, Allianz Suisse may request additional security checks or an extended identification process. The affected people are guided through the process accordingly in order to enable secure registration.

Access to the Customer Portal and/or the App takes place via a state-of-the-art registration procedure that serves to protect personal data against unauthorised access. Allianz Suisse may adapt or further develop the specific registration and login procedures used at any time.

Users are obliged to keep the information required for registration and use up to date. If certain contact details are required for a customer account, they must be uniquely assignable to a single person.

The owner of access to the Customer Portal and/or the App can only be an individual User. The account is not transferable.

Authentication is required to access the Customer Portal and/or the App. It is carried out using a process defined by Allianz Suisse that complies with the latest security standards.

Authentication may involve the use of several independent security features. Allianz Suisse is entitled to change or further develop the procedures used at any time.

The User can activate a biometric login method (facial recognition or fingerprint) in the App if desired. This allows the User to identify themselves automatically without a password and a temporary one-time password.

Anyone who authenticates themselves using their personal access data in the Customer Portal and/or the App is deemed to have proven their identity vis-à-vis Allianz Suisse. Allianz Suisse will make data and information accessible and accept orders and communications without further verifying the person’s access rights. It shall assume that the person is the customer and not an unauthorised third party.

Allianz Suisse is entitled to block access in whole or in part at any time (e.g. if abuse or manipulation is suspected or the Terms of Use have been breached). Allianz Suisse accepts no liability for any losses that occur as a result.

At the explicit request of the User, Allianz Suisse will block access to the Customer Portal and/or the App (e.g. if abuse is suspected). Until the block takes effect, the User bears the risk of use of their access.

By using the Customer Portal and/or the App, Users acknowledge that in future, documents and communications relating to Allianz Suisse may only be sent or provided to them electronically. This provision on electronic delivery shall take precedence over conflicting provisions in GTCs or other contractual documents, to the extent permitted by law.

Delivery shall be deemed to have occurred as soon as the relevant content is available in the Customer Portal and/or in the App. Users are responsible themselves for accessing and downloading the content provided in good time so that they can fulfil their contractual obligations on time.

A distinction is made between sending the documents by e-mail (see Risk Disclosure) and providing them via the Customer Portal and/or the App. If the latter method is used, as soon as documents have been made available there, the User will receive a notification to their e-mail address saved in the Customer Portal and/or in the App for electronic document delivery.

In addition, Allianz Suisse shall still be entitled to deliver the stored documents by post, in particular if required by law or if it appears appropriate due to other circumstances.

The User can request that the documents be sent by post at any time and set this up accordingly in the Customer Portal and/or in the App under “Settings”.

The User will be informed in good time about changes (e.g. deactivation of the portal).

The User is obliged to keep all access data such as e-mail address, password or login code confidential and to protect them against abuse. They are responsible themselves for ensuring that unauthorised persons do not have access to the Customer Portal and/or the App.

In particular, they must ensure that access details are not stored electronically in an in-secure manner, are not viewed by third parties while being entered, are not entered on third-party websites and are not passed on outside of the Customer Portal or the App (e.g. by e-mail, text message or telephone). Allianz Suisse never requests access details by e-mail, text message or telephone.

If there are reasonable grounds to suspect that an unauthorised third party has knowledge of the access details, the User must notify Allianz Suisse immediately and have their access blocked. The User shall bear the consequences of the use of their ac-cess details, even if such use is improper.

It is also the responsibility of the User to inform themselves about the necessary security precautions regarding the hardware and software they use. They are responsible for computer access and the Internet connection themselves and must take adequate, ap-propriate protective measures, such as using anti-virus and firewall programs.

When using mobile devices, the User must also take appropriate measures against un-authorised access by third parties, in particular activating a device or display lock and keeping the operating system and the App up-to-date. If they activate the biometric login method (see 6. Login), they must ensure that only their own biometric characteristics are stored on the device.

In the event of changes to their systems that are capable of compromising the security of the Customer Portal and/or the App or systems of Allianz Suisse (e.g. fault or failure in the functioning and/or integrity of technical equipment, programs and/or data of third parties and/or Allianz Suisse), the User undertakes to refrain from further use of the Cus-tomer Portal and/or the App and to inform Allianz Suisse immediately.

In addition, in the event of use from abroad, it is the responsibility of the User to inform themselves about the relevant data protection legislation and take appropriate measures if necessary.

Allianz Suisse strives to provide access to the Customer Portal and/or the App around the clock. Despite careful maintenance, uninterrupted operation (free of technical faults and disruptions) cannot be guaranteed and errors cannot be ruled out. However, Allianz Suisse endeavours to carry out planned system interruptions during off-peak hours. It accepts no liability for losses resulting from interruptions or technical faults.

All processing of personal data takes place in accordance with the applicable data pro-tection provisions, in particular the Swiss Data Protection Act (DSG) and – where appli-cable – the EU General Data Protection Regulation (GDPR).

Further information on data processing, in particular on the purposes, recipients and rights of the data subjects, is provided in the privacy policy.

The use of digital services takes place via public networks, in particular the Internet, and is therefore associated with inherent security risks. This includes in particular the risk of unauthorised access by third parties, data loss and data manipulation, as well as pos-sible restrictions on availability.

Allianz Suisse takes appropriate technical and organisational security measures in order to minimise these risks. However, absolute security and fault-free, uninterrupted availa-bility of the digital services at all times cannot be guaranteed.

To the extent permitted by law, Allianz Suisse accepts no liability.

It is not liable for direct or indirect losses resulting from transmission errors, technical defects, malfunctions in or disruptions of the network (network congestion) or Internet access, regardless of cause, business interruptions or illegal or fraudulent interventions or access by third parties, careless use of access details, blocking of access or any other reasons connected with the use of the Customer Portal and/or the App.

Allianz Suisse also is not liable for losses caused by malfunctions, interruptions (including system-related maintenance work) or overload of the IT systems of Allianz Suisse and its suppliers.

In addition, Allianz Suisse accepts no liability for the accuracy and completeness of the information and communications transmitted and displayed electronically or for any losses resulting from a lack of security or functionality of hardware or software.

Allianz Suisse accepts no liability for the content of linked external websites.

All rights to the Customer Portal and the App, including the underlying software and systems and all content contained therein (e.g. text, graphics, icons, audio and video materials, logos and brands) belong to Allianz Suisse, other companies in the Allianz Group or their licensors and are protected by copyright and trademark law in particular.

The User may use the Customer Portal and/or the App and their contents exclusively within the scope of the intended functions and in accordance with these Terms of Use. For this purpose, they are granted a single, non-transferable usage right for the duration of use which may be revoked at any time. Any other use requires prior written consent from Allianz Suisse. To the extent permitted by law, the following in particular are prohibited: editing, reproduction, storage, forwarding or publication of content beyond the intended use, reverse engineering or decompiling of software, circumvention of technical protection measures and systematic reading of content (e.g. by means of data mining or automated programs).

Allianz Suisse reserves the right to amend both the Online Services and the Terms of Use and to adapt them in line with technical or legal developments at any time. As a rule, changes will be announced electronically. In the event of continued use of the Customer Portal and/or the App, the changes shall be deemed to have been accepted.

The User can object to such changes. This is regarded as termination of use, whereupon Allianz Suisse will deactivate the User’s access (see 4. Start and end of use).

If parts of these Terms of Use are void or become legally unenforceable, the remaining provisions shall continue to apply.

These Terms of Use are governed by Swiss law. The exclusive place of jurisdiction is Zurich.
